1. Purpose of the Legal Notice

This Legal Notice governs access to and use of the website realestatescostablanca.com (hereinafter, the “WEB”) and the REC application (hereinafter, the “APP”), as well as their content and features.

The WEB and the APP form part of REC’s digital ecosystem, although they perform different functions. The WEB is primarily intended to provide information and present services, while the APP concentrates interactive, account, listing, search and contracting features for certain digital services.

Accessing or using the WEB or the APP confers user status and entails acceptance of the provisions of this Legal Notice to the extent applicable.

REC is the trading name used to identify the services and tools offered within this digital ecosystem.

3. Scope

This Legal Notice applies to:

  • the WEB realestatescostablanca.com;
  • the REC APP;
  • the pages, routes and features integrated into both;
  • and REC’s digital content or services that expressly refer to this Legal Notice.

Certain APP services are also subject to REC’s specific Terms and Conditions.

4. Access and use

General access to certain parts of the WEB and the APP may be available without registration.

Other features may require account creation, authentication, acceptance of specific terms or the purchase of a service.

The user undertakes to use the WEB and the APP lawfully, diligently and in accordance with this Legal Notice, the applicable Terms and Conditions, current law and third-party rights.

5. Proper use of the WEB and the APP

The WEB or the APP must not be used to:

  • carry out unlawful or fraudulent activities;
  • introduce or distribute malicious code;
  • attempt to access accounts, systems or data without authorisation;
  • deliberately interfere with the operation of the service;
  • use false identities or third-party data without lawful authority;
  • infringe intellectual property, industrial property, privacy or any other third-party rights;
  • or carry out any action contrary to current law.

REC may take measures reasonably necessary to protect the security and integrity of its systems and users.

6. Content and property information

REC endeavours to ensure that information displayed in its services is clear, useful and current.

However, certain property content may come from owners, collaborators, providers, external systems or inventory sources managed by third parties.

Property data, including price, availability, features, areas, photographs, location or market status, may change.

Published information does not, by itself, constitute an irrevocable contractual offer or guarantee that a property will remain available when the user expresses interest.

Where there is a relevant discrepancy, updated information must be verified before making a contractual decision.

7. User-provided content

Where the APP allows users to publish, upload or provide texts, photographs, documents, property data or other content, the user is responsible for having the necessary rights, authorisations and lawful authority to provide them.

The specific terms applicable to publication, processing and use of such content are governed by the Terms and Conditions.

8. Intellectual and industrial property

The elements comprising the WEB and the APP, including, where applicable, texts, design, structure, code, logos, trademarks, interfaces, graphics, photographs, audiovisual elements and other content, are protected by applicable intellectual and industrial property legislation.

Ownership may belong to REC or to third parties that have authorised their use.

Access to the WEB or the APP does not transfer to the user any intellectual or industrial property rights in those elements.

Their reproduction, distribution, transformation, communication to the public, exploitation or unauthorised use is prohibited unless permitted by law or expressly authorised by the relevant rights holder.

9. Trademarks and distinctive signs

REC, Real Estates Costa Blanca and other names, logos or distinctive signs used on the WEB or in the APP must not be used in a way that could cause confusion about their ownership, origin, sponsorship or commercial relationship.

Third-party trademarks, names and signs that may appear belong to their respective owners.

10. External links and third-party services

The WEB and the APP may contain links, integrations or access to sites, platforms or services managed by third parties.

REC does not generally control the content, availability, security, terms or policies of those external services and is not responsible for changes those third parties may make to them.

The inclusion of a link or integration does not necessarily imply approval, recommendation or association with the relevant third party.

The user must consult the terms and policies applicable to the external service where appropriate.

11. Technology tools and services

The APP may incorporate technology tools developed by REC or provided by third parties, including automated features and services relating to image processing, content, payments, infrastructure or artificial intelligence.

The specific contractual rules concerning REC Tools, credits, digital services, generated or transformed content, external providers and artificial intelligence features are set out in the Terms and Conditions.

This Legal Notice does not replace those terms.

12. Service availability

REC endeavours to keep the WEB and the APP available and operational, but cannot guarantee uninterrupted availability.

Interruptions may occur due to maintenance, updates, technical incidents, communications failures, third-party services, force majeure or circumstances beyond REC’s reasonable control.

REC may carry out maintenance, security or update work where necessary.

13. Accuracy and updates

REC takes reasonable measures to keep content under its control up to date.

However, there may be factual errors, temporarily outdated information or changes that have not yet been reflected.

Where REC becomes aware of a relevant error in content under its control, it may correct or update it.

14. Liability

REC will be responsible for its obligations in accordance with applicable law.

Nothing in this Legal Notice is intended to exclude or limit mandatory rights of consumers or users, or liability that cannot lawfully be excluded.

REC will not be liable for damage arising exclusively from unlawful user actions, false information provided by third parties, external services outside its control or circumstances for which it is not legally responsible.

The specific contractual liability rules relating to paid services or particular features are set out in the Terms and Conditions.

15. Security

REC applies technical and organisational measures intended to provide reasonable protection for its services.

However, no system connected to the Internet can guarantee absolute security.

The user must take reasonable measures to protect their credentials and devices and inform REC of any unauthorised access or security incident they detect in relation to their account.

16. Personal data protection

Personal data processing carried out through the WEB and the APP is governed by REC’s Privacy Policy.

That policy identifies the Data Controller, purposes, legal bases, recipients, transfers, retention periods and data subjects’ rights.

17. Cookies, storage and personalisation

The use of cookies, storage technologies and personalisation mechanisms is governed by the Cookies Policy.

Preferences relating to the WEB and the APP may be managed in accordance with the mechanisms available in each environment.

18. Contracting and paid services

The terms applicable to listings, REC Tools, credits, Professional, Branding, Featured and Private Location services, subscriptions, payments, taxes, electronic contracting, the right of withdrawal and other commercial APP services are governed by the Terms and Conditions.

In the event of a conflict between this Legal Notice and the specific terms of a service, the specific terms will prevail for that service, without prejudice to applicable mandatory law.

19. Changes

REC may amend this Legal Notice where necessary to adapt it to legal, technical or operational changes, or changes to the services offered.

The current version will remain permanently available through the WEB or the APP, indicating its update date or version.

Where a change requires consent or specific communication under applicable law, the corresponding procedure will be used.

20. Applicable law and dispute resolution

This Legal Notice is governed by Spanish law, without prejudice to mandatory protective rules that may apply to consumers resident in other territories.

Matters relating to contracts, consumers, jurisdiction and dispute resolution are governed in greater detail by the Terms and Conditions.

Nothing in this section limits the consumer’s rights under applicable mandatory law.

21. Relationship with the other legal texts

This Legal Notice must be read together with:

  • the Cookies Policy;
  • and the Terms and Conditions.

Each document governs a different subject and forms part of the legal framework of REC’s WEB + APP ecosystem.
