Terms and Conditions

These Terms and Conditions govern access to and use of the website realestatescostablanca.com (the Web), the REC application (the App) and the services, tools and features associated with both channels.
The Web and the App operate under the REC brand.
Where a feature requires acceptance of these Terms, the user must be able to consult them before becoming bound by the relevant contract or use.
1. Service owner

For the purposes of these Terms, REC identifies the brand and the services provided by the service owner identified above.
2. Scope
These Terms apply, as appropriate, to:
- browsing and using the Web and the App;
- creating and using accounts;
- listing and managing properties;
- property enquiries;
- REC Tools;
- purchasing and using credits;
- Professional;
- Branding;
- Featured Slots;
- Featured for seven days;
- Private Location Protection;
- payments, subscriptions and additional products;
- contact, alert and notification features.
Not all features are available to all user types.
3. User types
REC may be used by visitors, registered users, private advertisers, owners or authorised representatives, Professional users, consumers, traders or professionals and authorised administrators.
The commercial designation Professional does not, by itself, determine that the user legally qualifies as a trader.
Where a person enters into a contract as a consumer, they retain the mandatory rights afforded to them by applicable law.
4. Capacity and accuracy
The user declares that they have the capacity necessary to use or purchase the relevant service.
When acting on behalf of another person or entity, they must have sufficient authorisation.
The user is responsible for ensuring that the information provided is accurate, current, lawful and not misleading.
5. Accounts and authentication
Certain features require a registered and verified account.
Final publication of properties, REC Tools and payment features may require authentication, a verified email address, acceptance of terms and compliance with security controls.
The technical existence of anonymous authentication mechanisms does not mean that all features can be used anonymously.
6. Property listings
REC allows properties to be submitted for possible publication.
Submitting a property does not mean that it is published automatically.
New listings may remain pending review before being made public.
REC may approve, reject, pause, remove or request changes where there are reasons relating to accuracy, duplication, quality, lawfulness, the advertiser’s authority, availability, security or breach of these Terms.
7. Authority to advertise
Anyone listing a property declares that they have sufficient rights or authorisation to advertise it.
When acting as a representative, they must have authorisation from the owner or the person entitled to publish the listing.
8. Listing content
Listings must describe properties truthfully.
Deliberately publishing false or misleading information, fictitious prices, non-existent properties, unjustified duplicates, unlawful content, third-party material without authorisation or information that infringes third-party rights is not permitted.
Technical requirements relating to images, formats, size or quality may vary according to the property and feature.
9. Moderation
REC may use automated and manual content checks.
These checks do not guarantee that all incorrect, false or unlawful information will be detected.
The user remains responsible for the information they provide.
A significant change may require a new review before public visibility is restored.
10. Contact
Contact methods may vary according to the listing and account type.
Certain Professional listings may use the public contact details configured by the Professional.
In other cases, enquiries may initially be directed to REC.
REC does not guarantee that all listings allow direct contact between the advertiser and the interested person.
11. Relationship with property transactions
Listing a property on REC does not, by itself, make REC a party to a future sale, lease or other transaction between users.
Use of the portal also does not, by itself, mean that REC charges a commission on a future sale.
Property, legal, tax or intermediary services contracted separately may be governed by specific terms.
12. REC Tools
REC Tools currently includes features such as:
- Improve Photos;
- Remove Objects;
- Privacy Protect.
Access may require a verified account, available credits, compatible files and compliance with the relevant technical limits.
13. Artificial intelligence
Some tools use external artificial intelligence providers.
Currently:
- Improve Photos may use Google Gemini;
- Remove Objects may use OpenAI;
- Privacy Protect may use Gemini to detect potentially sensitive regions.
Automated systems may produce errors or unexpected results.
The user must review results before using or publishing them.
REC does not guarantee that an automated system will detect all sensitive elements or that every processed image will be suitable for every purpose.
14. REC Tools credits
Certain features use credits.
Credits:
- are allocated to the account;
- have no independent monetary value;
- cannot be exchanged for cash;
- are not transferable unless expressly enabled;
- currently do not expire while the account remains active.
Consumption depends on the tool and operation.
When a technical operation is not completed correctly, the system may release or restore the corresponding credit.
Restoring a credit for a failed execution does not automatically entail a cash refund for the credit package purchased.
15. Purchasing credits
Purchasing credits and subsequently running REC Tools are separate acts.
Purchasing a credit package does not, by itself, constitute the immediate execution of a REC Tools tool.
Purchasing credits will require acceptance of the applicable Terms, but the user will not be considered to have requested the immediate start of subsequent processing solely by making that purchase.
Before becoming obliged to pay, the user must be able to ascertain the product, number of credits, applicable price and other relevant contractual information.
16. Immediate execution of REC Tools
When the user decides to use their credits to run Improve Photos, Remove Objects or Privacy Protect, they are specifically requesting the start of the corresponding processing.
Where legally necessary, REC will separately request, before running the operation:
- an express request for immediate commencement;
- and a specific acknowledgement concerning the applicable consequences for the right of withdrawal where the execution and nature of the service require this.
These statements will not be presumed from general acceptance of these Terms alone.
Where applicable, they will be linked to the specific operation or job.
17. Professional
Professional is a paid service intended for users who need additional listing capacity and certain specific features.
Plans may differ according to the number of simultaneous listings allowed.
Professional does not automatically include REC Tools credits.
Activation may depend on payment, verification, the relevant declarations and compliance with listing rules.
Purchasing Professional does not constitute regulatory or official accreditation of the user.
18. Commencement of Professional
Provision of Professional may begin immediately once the contract has been confirmed.
Where a consumer requests that the service begin during the statutory withdrawal period, REC will separately obtain the express request required by law.
Early commencement will not automatically be interpreted as a general waiver of all rights of withdrawal.
Where legally applicable, the corresponding consequences for the part of the service already provided may apply.
19. Duration, renewal and cancellation of Professional
Professional operates through a recurring subscription in accordance with the period displayed before purchase.
Renewal will continue while the subscription remains active and has not been cancelled.
Where cancellation takes effect at the end of the paid period, the user may retain access until that date.
When the Professional entitlement actually expires:
- the user’s listings cease to remain publicly active;
- they may be paused;
- the corresponding capacity is released.
A subsequent renewal does not mean that previously paused listings are automatically republished.
20. Branding
Branding is an additional and independent service.
It may enable public presentation features, including a logo and brand content, subject to eligibility, payment and review where applicable.
The configuration may remain stored after the paid entitlement ends, even though it is no longer displayed publicly.
Provision of Branding may begin after the contract is confirmed.
Where legally required, a consumer user may expressly request that it begin during the withdrawal period.
Its activation will not automatically be considered a blanket waiver of the right of withdrawal.
21. Featured Slots
Featured Slots is a recurring service that provides capacity to feature eligible properties.
The quantity purchased, duration, price and renewal terms will be displayed before purchase.
Slots may be assigned or moved between eligible properties in accordance with the available features.
Moving a slot does not, by itself, restart the billing period.
Where the service is activated during an applicable withdrawal period, REC may expressly request the consumer’s agreement to early commencement.
Activation will not, by itself, constitute a general waiver of that right.
22. Featured for seven days
REC may offer a non-recurring Featured service lasting seven days for a specific property.
Before it begins, where legally applicable, the following will be requested separately:
- acceptance of the Terms;
- an express request for immediate commencement;
- acknowledgement of the legal consequences where the service is fully performed during the withdrawal period.
The controls must require a positive action by the user.
The Featured service may end earlier if the property ceases to be eligible, is sold, is removed or ceases to meet its conditions.
23. Private Location Protection
Private Location Protection is a paid service associated with a specific property.
It is not a recurring subscription unless expressly stated otherwise.
It may begin immediately after the contract is entered into.
Where the user is a consumer and it is legally necessary, REC will separately request an express request for immediate commencement.
Activation alone will not be considered an automatic and blanket waiver of the right of withdrawal.
24. Prices
The applicable prices will be those displayed during the contracting process.
The contractual prices used by REC are determined from the corresponding product configuration and must not depend on static displayed amounts that may become outdated.
Before becoming bound, the user must be able to ascertain the product and the applicable amount.
25. Taxes
Where legally required, the total price, including applicable taxes, will be displayed before final confirmation.
Where the tax calculation first requires billing, location or tax identification data, the final total will be displayed before payment is confirmed.
REC does not use a fixed hardcoded VAT rate as a substitute for the applicable tax calculation.
26. Payments through Stripe
Payments are processed through Stripe.
When Stripe-hosted Checkout is used, REC does not receive the full card number.
The browser’s return from Stripe does not, by itself, grant a product, credit, subscription or entitlement.
REC verifies the payment status and the relationships between the user, product, price and, where applicable, property before granting the purchased entitlement.
27. Electronic contracting
The procedure may include:
- selecting the product;
- presenting its features;
- presenting the price;
- authentication where necessary;
- presentation and acceptance of the Terms;
- additional specific consents where applicable;
- checking the necessary information;
- the opportunity to correct data before completion;
- payment;
- verification of the transaction;
- activation;
- confirmation of the contract.
REC may retain electronic evidence of the contract.
28. Contractual evidence
Depending on the product, contractual evidence may include:
- version of the Terms;
- date and time;
- UID;
- product;
- quantity;
- related property;
- language or locale;
- session identifier;
- payment or subscription reference;
- specific statements concerning early commencement where applicable.
Privacy information will be kept separate from contractual acceptance of the Terms.
29. Confirmation
Following a successfully completed contract, REC will make available to the user a confirmation that can be retained and may include or link to:
- the product purchased;
- the amount charged;
- the transaction reference;
- whether it is recurring or non-recurring;
- the version of the Terms;
- specific statements made during the contracting process.
30. Right of withdrawal
Where the user legally qualifies as a consumer, they will have the right of withdrawal applicable under current law.
Where applicable, the general withdrawal period for distance contracts will be 14 calendar days.
Valid exercise of the right of withdrawal will not be subject to a penalty.

The above is without prejudice to the exceptions and specific rules legally applicable to digital services and digital content.
31. Early commencement and withdrawal
General acceptance of these Terms does not replace the specific statements legally required to begin certain services early during the withdrawal period.
REC will request the corresponding separate actions where the product or service requires them.
The consequences for withdrawal will depend on:
- the legal nature of the product;
- the user’s express request;
- the extent of performance;
- and compliance with the applicable legal requirements.
32. Refunds and failures
Technical failures will be handled according to the nature of the product.
In REC Tools, where an operation is not completed correctly, the system may release or restore the corresponding credit.
This does not automatically entail a cash refund for the credit package purchased.
Where REC cannot provide a paid service for reasons attributable to REC, the corresponding remedies under applicable law will apply.
Nothing in these Terms limits the consumer’s mandatory rights.
33. Cancellation of subscriptions
Subscriptions may be cancelled through the available mechanisms.
The relevant interface or portal will indicate when cancellation takes effect.
Where it takes effect at the end of the paid period, no further renewals will occur once that date is reached.
Cancellation of a future renewal does not automatically entail a refund for the period already paid for, without prejudice to applicable legal rights.
34. Account deletion and subscriptions
Deletion of a REC account ends the operational access associated with it.
Recurring subscriptions linked to the account must be cancelled so that no future renewals can occur against a deleted account.
REC carries out the corresponding checks before finally completing deletion.
If the required cancellation of a subscription cannot be completed correctly, final account deletion must not be presented as completed while a risk of renewal remains.
35. Account deletion and credits
Before completing deletion of an account with remaining REC Tools credits, REC may display the corresponding consequence.
Purchased or promotional credits:
- do not expire while the account is active under the current operation of the service;
- are deleted when the account is voluntarily deleted;
- cannot be exchanged for cash;
- are not eligible for a discretionary refund merely because the account is closed.
All of the above is without prejudice to the consumer’s mandatory rights.
36. User-provided content
The user retains the rights they hold in photographs, texts, logos, floor plans, documents and other content provided.
By providing them, the user declares that:
- they own them or have sufficient authorisation;
- their use does not infringe third-party rights;
- they have sufficient lawful authority to use them in connection with the service.
37. Necessary licence
The user grants REC a non-exclusive and limited licence, for the time necessary to provide the service, to:
- store;
- make technical reproductions;
- adapt formats;
- resize;
- convert;
- display publicly where the user requests publication;
- transmit to necessary providers;
- process through the tools purchased;
the content provided.
This licence does not transfer ownership to REC.
38. REC Tools results
The user may use results in accordance with applicable law and existing rights in the original material.
REC does not guarantee that a result generated using artificial intelligence:
- will be identical to the original;
- will be free from errors;
- will represent all elements with absolute accuracy;
- will be suitable for every legal, technical or commercial purpose.
The user must review images before using them in property advertising.
The user must not use processed images in a way that could materially mislead others about the property’s actual features.
39. Availability
REC endeavours to keep its services operational but does not guarantee uninterrupted availability.
Maintenance, interruptions, provider errors, quota restrictions, network failures, timeouts, incompatibilities and partial failures may occur.
REC may temporarily suspend certain features for technical, legal or security reasons.
40. Temporary files
Results and files generated by certain tools may remain available only for a limited period.
The lifetime of a download link may be shorter than the file’s technical storage period.
The user is responsible for downloading and retaining results they wish to keep.
REC does not guarantee permanent storage of REC Tools results.
41. Prohibited uses
REC must not be used to:
- breach the law;
- infringe third-party rights;
- deliberately publish false information;
- commit fraud;
- manipulate payments;
- circumvent limits;
- interfere with security;
- exploit vulnerabilities;
- access other people’s accounts;
- distribute malicious software;
- abusively automate the service;
- use content for which sufficient rights are not held.
42. Suspension and termination by REC
REC may restrict, suspend or terminate access where there are reasonable grounds relating to breach, fraud, abuse, security, non-payment, unlawful content, impersonation, risk to third parties or a legal obligation.
Where reasonably possible and legally appropriate, REC will inform the user.
43. Liability
REC will be liable under applicable law for its own breaches.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
REC will not be liable for false information provided by users of which it could not reasonably have been aware, contracts entered into directly between users where REC is not a party, copies made by third parties outside REC, or failures exclusively attributable to the user’s device, connection or software.
44. External providers
REC uses external providers for certain features, including Stripe, Google/Firebase, Gemini, OpenAI and other technical services.
The use of providers does not remove responsibilities that legally fall on REC.
External services may additionally be subject to their own terms.
45. Changes to the Terms
REC may update these Terms when services, features, legislation, providers, contracting models or security requirements change.
Each version will be identified by a date or version number.
Changes will not retrospectively affect acquired rights unless legally permitted.
46. Languages
REC may offer these Terms in different languages.
Efforts will be made to maintain consistency between translations.
Any issue arising from translations will be resolved in accordance with applicable law and the information provided to the user during the contracting process.
47. Applicable law
These Terms are governed by Spanish law, without prejudice to mandatory rules protecting consumers resident in other territories where applicable.
48. Consumers and jurisdiction
Where the user legally qualifies as a consumer, jurisdiction and dispute resolution will be governed by the applicable mandatory rules.
Nothing in these Terms requires a consumer to submit to a court other than the court to which they are legally entitled.
