Power of attorney
Sign remotely without slowing your purchase: a power of attorney makes it easy
With a valid, well-drafted power of attorney you can authorise a representative to sign contracts, the deposit and the deed, even if you are outside Spain.
What is a power of attorney and what is it for in real estate?
A power of attorney is a formal authorisation granted before a notary by which one person (principal) empowers another (attorney-in-fact) to act on their behalf. In property purchases, it allows you to sign contracts, the deposit, the mortgage or the deed without travelling. It saves trips, shortens timelines and avoids a deal falling through due to scheduling or distance.

Concrete advantages when buying or selling
Time saver: your attorney signs at the notary while you carry on with your agenda.
Remote purchase: ideal for non-residents or buyers abroad.
Continuity: if something unexpected happens, your attorney prevents delays and penalties.
Legal certainty: the power of attorney text precisely defines what your attorney can and cannot do.
Most used types in a purchase
Special power of attorney
Grants authority for one or several very specific acts (e.g., sign
earnest money agreement, execute the deed, cancel a mortgage). Recommended for precision and lower risk.
General power of attorney
Broad faculties for various patrimonial acts. Useful for ongoing management but must be carefully delimited to avoid excesses.
Preventive power
Prepares for supervening incapacity. Less common for one-off purchases but useful in long-term asset management.
Buying from abroad: how to use the power of attorney
If you are abroad, you can sign the power of attorney before a local notary and obtain the apostille (Hague Convention) or appear before the Spanish Consulate. With a sworn translation where required, it will be fully valid so your attorney can sign in Spain.
Coordinated timeline with notary and bank to avoid extensions and penalties.
Common risks and how to avoid them
Excessive scope: a power of attorney that is too broad may allow undesired acts. Solution: use a special power limited to this transaction.
No expiry: if time isn’t limited, it could be used months later. Solution: set validity (e.g., 90 days) or automatic revocation after completion.
Language & legalisation: without apostille or sworn translation, the power may be rejected. Solution: a prior document checklist.
Poor coordination: if bank–notary–attorney aren’t aligned, costly extensions in the deposit or taxes may follow.
Checklist: what a good power of attorney for a purchase should include
1) Full identification of principal and attorney (name, ID, address).
3) Property data: address, Land Registry details, cadastral ref if known.
4) Limits: price/conditions caps; your prior approval for material changes.
5) Validity: reasonable expiry (30–90 days) or revocation after completion.
6) Language & legalisation: sworn translation and apostille if signed abroad.
7) Tax & payments: funds provision, purchase taxes (
ITP/VAT/AJD) and registry fees.
FAQs
Where can I grant the power of attorney if I live abroad?
Before a local notary with apostille or at a Spanish Consulate. We arrange sworn translations if needed.
How long does it take?
Usually a few days if we have property and attorney details and coordinate with the notary from the start.
Can I limit the scope?
Yes. We recommend a special power of attorney with price and time limits for maximum security.

Yes, as long as it is expressly included and the bank accepts it. We coordinate with your lender.
