Documents Needed to Sell a Property in Spain
Selling a property in Spain as a foreign owner involves specific legal requirements and documentation. To avoid delays, it’s crucial to prepare everything in advance. R E C provides a complete checklist of what you’ll need to ensure a successful transaction.
Essential documents to gather
- 📜 Title Deed (Escritura Pública): Proves ownership and is required at the notary.
- 📑 Land Registry Extract (Nota Simple): An updated document from the Spanish Land Registry confirming legal status and ownership.
- 🧾 NIE Number: Spanish tax identification number required for all legal transactions.
- 💡 Energy Efficiency Certificate (CEE): Mandatory since 2013, must be presented before marketing the property.
- 🏘️ IBI Receipt: Proof of up-to-date local property tax payments.
- 📋 Community Fees Certificate: Confirms no debts are owed to the owners' community (for apartments or urbanizations).
- 🏦 Bank account certificate: Optional but recommended if payment will be handled locally.
If the property has a mortgage
- 📄 Mortgage Cancellation Certificate: From your bank, confirming the loan is paid off or to be cancelled at closing.
