Legal Checklist Before Selling a Property in Spain
Before you put your property on the market, you need to ensure your documentation is 100% in order. At R E C, we guide sellers through each step of the process — and this legal checklist is where it starts.
✅ 1. Title Deed (Escritura Pública)
Make sure you have the original or a notarized copy of your title deed, proving ownership and legal registration.
✅ 2. Nota Simple (Property Registry Extract)
This official document confirms the legal status of the property — including ownership, debts, or charges. It must be recent (within 3 months).
✅ 3. Energy Performance Certificate (CEE)
This is mandatory for all properties sold in Spain. It must be issued by a certified technician and included in marketing.
✅ 4. IBI Tax Receipts
You must show proof of payment for the local property tax (Impuesto sobre Bienes Inmuebles) for the current year.
✅ 5. Utility Bills
Electricity, water, gas — buyers will want to confirm there are no unpaid balances. Prepare your latest receipts.
✅ 6. Community Certificate (if applicable)
If your property is in a complex or apartment block, you’ll need a certificate from the administrator showing you're up to date with community fees.
✅ 7. NIE Number
A valid NIE (Foreigner Identification Number) is required to appear at the notary and receive the sale funds.
✅ 8. Mortgage Information (if applicable)
If the property has an active mortgage, prepare a statement from the bank and plan for cancellation costs.
✅ 9. Power of Attorney (Optional)
If you're selling remotely, a POA can allow a lawyer or agent to sign on your behalf. We can coordinate this for you.
